1. Agreement to Terms

By accessing and using Night Watcher AI, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the service.

2. Use License

You may use Night Watcher AI for personal and internal business research, including permitted exports and generated reports, subject to your plan and applicable third-party rights. You retain your rights in content you submit and authorize us and our providers to process it to deliver the service. You must have permission to submit that content.

Do not resell access or our underlying datasets, bypass access controls, share credentials outside authorized team access, or use the service unlawfully. Access may be restricted for abuse or material violations. AI outputs may not be unique and must be reviewed before use.

3. Disclaimer

The materials on Night Watcher AI's website are provided on an 'as is' basis. Night Watcher AI makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations

To the extent permitted by applicable law, Night Watcher AI and its suppliers are not responsible for indirect or consequential losses arising from reliance on research or AI outputs. Nothing in these terms excludes liability or consumer rights that cannot lawfully be excluded.

5. Accuracy of Materials

Research data and AI answers may be incomplete, outdated or incorrect. Traffic and keyword metrics are third-party estimates; revenue models are scenarios based on assumptions, not reported company financials. The service does not guarantee rankings, revenue or business outcomes and does not provide personalized investment advice. Verify important conclusions independently.

6. Links

Night Watcher AI has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Night Watcher AI of the site.

7. Modifications

We may update these terms and will publish a revised date on this page. We will provide additional notice of material changes where required by applicable law. Changes do not remove rights already earned under an existing guarantee.

8. The One-Opening Guarantee

If, within 7 days of your first payment, you have not found one opening worth building, email jcole@nightwatcherai.com within those 7 days and we will refund your first month. On an annual plan we refund one twelfth of the annual price. The guarantee applies once per customer, to your first paid period only, and does not apply to plan changes, renewals, or accounts that are shared or resold. Refunds are returned to the original payment method within 10 business days.

9. Subscriptions and Cancellation

Paid subscriptions renew at the interval and price shown at checkout unless canceled. Cancel renewal through Account settings before the next renewal; access normally continues through the current paid period. Cancellation does not itself delete your account or research, and a deletion request does not immediately cancel billing. Contact jcole@nightwatcherai.com for billing assistance, refund requests or account closure. The seven-day guarantee above applies alongside any refund or cancellation rights required by law. Review displayed billing details before confirming plan changes or a pause; pausing is not cancellation.
